These terms are a starting template and must be reviewed by a Canadian lawyer before launch. Replace bracketed items.
The service
HSA Benefits ("we") administers Health Spending Accounts structured as Private Health Services Plans under the Income Tax Act (Canada) for eligible employers ("you"). We process claims, reimburse eligible medical expenses to plan members, and bill you for approved claims, fees and applicable taxes.
Eligibility
Plans are available to businesses operating in Canada, outside Quebec, that employ plan members who receive employment (T4) income. You confirm that you have consulted your accountant about the tax treatment of the plan.
Fees
You pay the per-claim fee shown on our pricing page at the time a claim is approved, plus applicable provincial premium tax, retail sales tax and GST/HST, and any payment processing fees. There are no setup or annual fees. We will give 30 days’ notice of any fee change.
Funding
For prepaid plans, approved claims are paid from your wallet. Claims wait until there are enough funds. Unused wallet funds are refundable on cancellation, less any amounts owing.
Claims decisions
We decide claims under CRA rules for eligible medical expenses, using automated checks and human review. Plan members can ask for a review of any decision by contacting info@hsabenefits.ca.
Privacy
We handle personal and health information as described in our Privacy Policy. Employers do not receive plan members’ receipts or medical details.
Partners
Partners who refer employers earn commission on platform fees as set out in their partner agreement. Partners can see client setup and totals, but not plan members’ medical information.
Termination
Either party may cancel at any time. Claims for expenses incurred before cancellation may be submitted for 30 days afterwards.
Liability
[Limitation of liability clause to be drafted by counsel.]
